General Terms and Conditions of Use
The services of the simpatie.ro platform are provided by the company DENIRO MEDIA INVEST SRL, unique identification code 43296393, registered with the Trade Register under no. J40/14890/2020, with its registered office in Bucharest, Str. Zizin no. 10, Commercial Space 2, Room 2, Sector 3, e‑mail: support@simpatie.ro. The services are intended exclusively for persons who have reached the age of 18. Accessing, creating an account and using the platform imply full and unconditional acceptance of these Terms and Conditions, in the version in force at the time of use. DENIRO MEDIA INVEST SRL reserves the right to modify or update the content of these Terms and Conditions at any time, without prior individual notice to users. The updated version will be published on the site and will take effect from the date of its display. If the user does not agree with the changes made, they have the right to immediately cease using the simpatie.ro services and to request the deletion of their account.
1. General conditions
The entire content of the simpatie.ro platform, including, but not limited to text, graphic elements, logos, design, databases, photographs, audio‑video materials, source code and any other information displayed, is the property of DENIRO MEDIA INVEST SRL or is lawfully used under usage rights and is protected by Romanian and European legislation on copyright, trademarks and intellectual property rights.
Copying, reproducing, distributing, publishing, modifying, transferring, transmitting, storing, selling, reselling or exploiting in any form the content available on simpatie.ro, in whole or in part, is strictly prohibited without the prior written consent of the rights holder.
The use of any automated or manual data‑extraction methods, including scraping, crawling, systematic copying or the creation of derived databases, is strictly prohibited.
DENIRO MEDIA INVEST SRL reserves the right to restrict or suspend access for users who violate the provisions of these Terms and Conditions without prior notice.
The simpatie.ro platform may contain links to external websites operated by third parties. DENIRO MEDIA INVEST SRL assumes no responsibility for the content, privacy policy, operation or security of these external sites; access to them is at the user’s own risk.
2. Description of the platform and services
The simpatie.ro platform provides users with digital entertainment and online socialization services, consisting of facilitating virtual interaction among members through features specific to dating platforms, including profile creation, message exchange and access to advanced options available for a fee.
The services are provided exclusively in digital format via the online platform and do not involve the delivery of physical goods or the provision of services outside the virtual environment.
Access to certain platform features is free, while other services may only be available based on a subscription or online payment, according to the rates displayed on the site at the time of purchase.
simpatie.ro does not guarantee the establishment of real relationships, physical meetings, romantic outcomes or compatibilities between users. The platform has the nature of online entertainment, and the interactions carried out through it do not constitute promises or obligations of result from the operator.
DENIRO MEDIA INVEST SRL reserves the right to modify, suspend, add or remove features, services, rates or subscription structures at any time without prior individual notification, the changes being displayed on the site and applicable from the date of their publication.
Any additional services implemented later on the platform will be subject to these Terms and Conditions, except in situations in which separate terms of use are established for them, expressly communicated to users.
3. Registration and account creation
To use the services offered by the simpatie.ro platform it is necessary to create a user account by choosing a user name and a personal, confidential password. The user is responsible for keeping the authentication data secure and for all activities carried out through their account.
At the time of registration, the user declares on their own responsibility that:
• they are at least 18 years old;
• they provide real, correct and up‑to‑date information;
• they use the platform exclusively for personal and lawful purposes.
In the case of providing false, inaccurate, incomplete or misleading information, DENIRO MEDIA INVEST SRL reserves the right to suspend or permanently close the account, without prior notice and without the obligation to refund any amounts paid.
The data collected through the registration forms are not sold or transferred to third parties, being used exclusively for the purpose of providing the services, in accordance with the Privacy Policy.
Any behavior that damages the image of the platform or of other users is strictly prohibited, including, but not limited to:
• offensive, threatening, discriminatory or obscene language;
• harassment, intimidation or abusive behavior;
• the use of fake photos, images of other people or materials that do not belong to the user;
• using the platform for commercial, advertising or external promotional purposes.
Such behavior may result in temporary or permanent suspension of the account, as well as restriction of future access to the simpatie.ro services.
The platform may occasionally grant bonuses, benefits or promotional facilities, of a limited and non‑transferable nature. These may be withdrawn at any time in case of abusive or fraudulent use of the service.
Each account is assigned a validity period. Access to premium features can be extended by online payment with a bank card or by SMS, according to the rates displayed on the site at the time of purchase.
DENIRO MEDIA INVEST SRL reserves the right to modify the structure, duration or access conditions of the services, as well as to individually restrict certain accounts in case of non‑compliance with these Terms and Conditions.
Creating and using multiple accounts by the same person, as well as carrying out advertising, promotion or redirection activities to other platforms, leads to the cancellation of benefits and the closure of accounts, without the right to compensation.
4. Protection of personal data
DENIRO MEDIA INVEST SRL processes users’ personal data in accordance with Regulation (EU) 2016/679 on the protection of personal data (GDPR) and Law no. 190/2018, under conditions of legality, transparency and security.
Personal data are collected and used exclusively for the purpose of providing the services offered through the simpatie.ro platform, for the administration of user accounts, for processing payments, for preventing fraud and for complying with the legal obligations applicable to the operator.
Detailed information regarding the types of data collected, the purposes of processing, the legal grounds, the storage duration, users’ rights and the security measures are presented in the Privacy Policy, a separate document and an integral part of these Terms and Conditions.
By using the simpatie.ro platform, the user confirms that they have read the contents of the Privacy Policy and express their agreement regarding the processing of personal data under the conditions described therein.
Bank card data are not collected or stored by simpatie.ro, payments being processed exclusively through authorized electronic payment processors, in accordance with the PCI‑DSS security standard.
Users may exercise at any time the rights provided by the GDPR, including the right of access, rectification, erasure, restriction, objection and portability, by sending a request to the email address: support@simpatie.ro.
5. Content and interactions on the platform
The term “Content” means any information available on the simpatie.ro platform, including, but not limited to: texts, photographs, descriptions, messages, graphic elements, profile data, audio‑video materials, software functionalities and any other materials displayed or generated within the service.
The platform content is the property of DENIRO MEDIA INVEST SRL or is legally used under licences or usage rights and is protected by copyright and intellectual property laws. It may not be copied, reproduced, distributed, transmitted, published, sold or exploited in any form without the prior written consent of the rights holder.
The platform may contain links to external content sources administered by third parties. DENIRO MEDIA INVEST SRL assumes no responsibility regarding the availability, operation, correctness or legality of these external sources.
5.1 Prohibited content
It is strictly prohibited to publish or transmit, in any form, the following types of content:
• nude materials or pornographic content;
• content of an explicit sexual nature;
• materials that promote violence, hatred, xenophobia, discrimination or illegal activities;
• images or information that violate the rights of other persons;
• false, misleading content or content that may cause reputational damage.
simpatie.ro reserves the right to moderate, restrict, remove or block any content that violates these rules, as well as to suspend or close the accounts of the users involved, without prior notice.
5.2 Nature of the service and the use of artificial intelligence
simpatie.ro is a digital entertainment and online socialization platform. The service does not guarantee interactions with real people and does not offer promises regarding the establishment of relationships, physical meetings or romantic outcomes.
Users are informed and expressly accept that, in order to improve the user experience, certain functionalities, profiles, messages or dialogues may be generated, assisted or simulated partially or entirely by artificial‑intelligence systems.
These interactions are for entertainment purposes only and do not represent real identities, existing persons or guaranteed human communications.
The scenarios, characters, conversations, situations and locations presented within the service may be fictitious.
The use of these functionalities is included in the standard service fee and does not involve additional costs.
5.3 Limitation of liability
DENIRO MEDIA INVEST SRL is not liable for:
• the accuracy or truthfulness of information provided by users;
• the behaviour of users outside the platform;
• the consequences of interactions between members;
• any personal expectations of users regarding the results of the service.
5.4 Modification of content rules
DENIRO MEDIA INVEST SRL reserves the right to modify, update or supplement at any time the rules regarding content and the operation of the platform, the changes becoming applicable from the date of publication on the site.
6. Rights of the operator
DENIRO MEDIA INVEST SRL, as the operator of the simpatie.ro platform, reserves the following rights:
• to carry out at any time maintenance work, updates, technical improvements or revisions of the platform, during which the site may be temporarily unavailable or may function partially; users will be informed only if the maintenance period exceeds 24 hours;
• to verify, approve, reject or remove photos and materials uploaded by users when these do not comply with the rules of the platform; repeated refusal of the same materials may lead to the restriction of the right to upload photos;
• to not manually intervene on profile content at the users’ request, modifications being possible exclusively by users from their own account;
• to send administrative, technical or commercial notifications to users through the platform or by email, under the terms of the law;
• to not be responsible for the inability to access the service caused by device settings, browsers, internet connection or other external factors independent of the platform;
• to cancel, modify or withdraw the benefits, free offers or bonuses granted at registration or within promotional campaigns in the case of improper or fraudulent use of the services;
• to suspend or close the accounts of users who violate these Terms and Conditions, without the obligation to refund all or part of the amounts paid for services already provided;
• to refuse access to the platform to persons who, through their behaviour, affect the good functioning of the simpatie.ro community, the safety of other users or the image of the platform;
• to limit, restrict or block users’ access in situations of reasonable suspicion of fraud, abusive use, violation of the law or of the requirements imposed by payment processors.
7. Rights and obligations of users
The user has the right to request the deletion of their account at any time by sending a written request to the simpatie.ro team, using the contact details indicated on the site. Account deletion is carried out by the administrator, in accordance with internal procedures and the applicable data‑protection legislation.
Any person has the right to request the removal of an account if the data or images used in the profile are used without right or in violation of their rights.
The user is fully responsible for the content posted, messages sent, information provided and for the consequences of their actions. DENIRO MEDIA INVEST SRL assumes no legal responsibility for the information, opinions or materials posted or transmitted by users through the platform.
The user undertakes to use the simpatie.ro platform legally, responsibly and in compliance with the following rules:
• not to use vulgar, obscene, offensive, threatening or discriminatory language;
• not to publish or offer services of a sexual nature, escort, video chat or other similar commercial activities;
• not to create or use multiple accounts or profiles;
• not to collect, use or distribute the contact data of other users without their consent;
• not to send unsolicited, advertising or repetitive messages (spam);
• not to solicit money, goods or material advantages from other users, including through fraudulent methods or schemes such as “reload code”, “rapid transfer”, “Western Union” or similar;
• not to upload photos, video materials or content of a nude, pornographic or explicitly sexual nature;
• not to use the platform for illegal, fraudulent purposes or in ways that may harm other people.
The user understands and agrees that the interactions carried out through the platform are exclusively virtual and that any meeting or communication outside the platform takes place at their own responsibility.
In the event of non‑compliance with the above obligations, DENIRO MEDIA INVEST SRL reserves the right to suspend or close the user’s account, temporarily or permanently, without prior notice and without the obligation to refund the amounts paid.
8. Liability and compensation
DENIRO MEDIA INVEST SRL is not responsible for the malfunction, interruption, errors or irregularities of the services provided by third parties, including, but not limited to providers of payment services, electronic communications, hosting or other contractual partners. Any complaint regarding their services will be addressed directly to the responsible provider.
The simpatie.ro platform is made available to users “as is”, without express or implied warranties regarding permanent availability, absence of technical errors or compatibility with all devices or computer systems.
DENIRO MEDIA INVEST SRL cannot be held liable for:
• the content published or transmitted by users;
• their behaviour, statements or actions;
• financial, emotional or opportunity losses resulting from the use of the platform;
• the temporary unavailability of the service for technical or maintenance reasons;
• any material or moral damages resulting from interactions between users, from virtual communications carried out through the platform, as well as from the use of automated functionalities or artificial‑intelligence systems, which do not represent real persons and cannot generate obligations or guarantees on the part of the operator.
The user is solely responsible for their use of the platform and for the consequences that may result from it.
If, through their actions or omissions, the user causes material or reputational damage to the simpatie.ro platform, DENIRO MEDIA INVEST SRL reserves the right to seek full recovery of the damage, including administrative, legal and representation costs.
DENIRO MEDIA INVEST SRL reserves the right to initiate legal actions against any natural or legal person, group of persons or entities that violate the provisions of these Terms and Conditions or the applicable legislation.
The fact that a user has not read the provisions of this document cannot be invoked as grounds for exemption from liability.
9. Payments by SMS or bank card
Access to certain features of the simpatie.ro platform is available exclusively on the basis of an online payment, through electronic payment services or by SMS, according to the rates displayed on the site at the time of payment.
9.1 Rates
The fee for activating premium functions by SMS is EUR 6.10 + VAT, offering a validity period of 14 days. The fee for activating premium functions by bank‑card payment is EUR 36 + VAT, for a duration of one calendar year. These rates may be updated periodically. The final applicable price is displayed transparently to the user before payment confirmation.
9.2 Payment by SMS
Users of the Vodafone, Orange, Telekom and Digi networks can make the payment by SMS by sending the keyword displayed on the site to the short number 7505, following the steps communicated in the messages received.
• initial fee for sending the SMS: EUR 0.05 + VAT
• service charge: EUR 6 per SMS + VAT
• charging is made immediately after payment confirmation
• the account is activated automatically after successful completion of the transaction
For additional information regarding the SMS service, users can access the Help section or call the number 1808 (standard rate), available Monday to Friday, between 10:00 – 18:00.
9.3 Online payment by bank card
Payment by bank card is made through authorized electronic payment processors (PayU), under security conditions in compliance with the PCI‑DSS standard.
simpatie.ro does not collect or store bank‑card data. They are processed exclusively by payment service providers.
9.4 Nature of the digital service and the absence of the right of withdrawal
By making the payment, the user confirms that they are requesting the immediate provision of a digital service, consisting of the instantaneous activation of premium functionalities (including, but not limited to the unlocking of messaging).
In accordance with art. 16 lit. m of Government Emergency Ordinance no. 34/2014, the user understands and accepts that they do not benefit from the right of withdrawal after the start of the provision of the digital service.
Therefore, after activation of the digital service, payments cannot be cancelled and are not refundable, in whole or in part, except in situations where the refund is required by law or is justified by: (i) proven unauthorized transactions, (ii) double charging, (iii) technical errors attributable to the operator that have prevented the provision of the service.
Therefore:
• the payments made cannot be cancelled;
• the amounts paid are not refundable, in whole or in part, after activation of the service.
9.5 No automatic renewal
Premium subscriptions/activations purchased by SMS or bank card do not renew automatically. Upon expiration of the purchased period, premium access ceases, and extension can be done only through a new payment initiated by the user.
9.6 Transaction descriptor and payment identification
Card payments made on simpatie.ro are processed through PayU. The transaction may appear on the account statement under a descriptor such as “DENIRO MEDIA INVEST SRL” and/or “SIMPATIE.RO” (depending on the issuing bank and its display rules).

9.7 Invoicing, currency and VAT
Prices are displayed including VAT, and the final price is shown before payment confirmation. If the payment is made in a currency other than the one displayed, the currency conversion is carried out by the issuing bank and/or by the payment service provider, according to their terms.
Upon request, users may receive supporting documents in accordance with the applicable legal obligations.
10. Agreement and final provisions
By accessing, registering and using the simpatie.ro platform, the user declares that they have read, understood and expressly and unconditionally accept the provisions of these Terms and Conditions, as well as the related documents that form an integral part of them, namely:
• the Privacy Policy;
• the Cookie Policy;
• the Refund and Cancellation Policy;
• Any other policies displayed on the platform.
If the user does not agree, in whole or in part, with these provisions, they are obliged to immediately stop using the services and not access the content of the simpatie.ro platform.
Any violation of the rules or inappropriate behaviour may be reported to the simpatie.ro team via the contact details displayed on the site, and the reports will be analysed according to internal procedures.
11. Complaints and dispute resolution
Any notification or complaint regarding the services of simpatie.ro must be sent to support@simpatie.ro, with a description of the situation and, if applicable, details identifying the account and/or transaction.
The operator will analyse the request and respond within a reasonable time, usually within a maximum of 30 calendar days, depending on complexity.
Users are encouraged to first contact the simpatie.ro team before initiating a bank dispute (chargeback) to allow for verification and amicable resolution.
12. Applicable law and jurisdiction
These Terms and Conditions are governed by Romanian law. Any dispute will be settled, with priority, amicably and, in case of failure, by the competent courts of Romania, in accordance with the law.
13. Reporting content and appealing decisions
Users can report content or behaviours that violate the platform rules via the reporting functions on the platform or at support@simpatie.ro. Reports should include, as far as possible, a profile link/ID, relevant screenshots and a description of the reason.
The operator may remove content, restrict features or suspend/close accounts following verification. Users may contest a measure applied to their account by sending a request to support@simpatie.ro, after which the situation will be re‑evaluated.
DENIRO MEDIA INVEST SRL reserves the right to periodically update these Terms and Conditions. The version in force is the one displayed on the site at the time of service use.
This document constitutes the complete legal agreement between the user and DENIRO MEDIA INVEST SRL regarding the use of the simpatie.ro platform.
